These terms apply when a Shopify merchant (“you”) installs or uses an app made by 89 Design Lab (trading as Lab89) (“Lab89”, “we”), including Pollsy, Discount Health and GiftSplit (each, “the App”). By installing the App you agree to these terms.
We provide the App as described on its Shopify App Store listing. We may improve, change or remove features. If we remove a feature that is central to your paid plan, we’ll tell you in advance.
You need a Shopify store to use the App. You are responsible for who in your team can access it.
Paid plans, free trials and usage charges are billed by Shopify, on Shopify’s billing cycle. Free trials convert to the paid plan unless you cancel or downgrade before the trial ends. Usage charges never exceed the cap you approved in Shopify. Fees are non-refundable except where the law or Shopify’s policies require a refund. We may change prices with at least 30 days’ notice.
Don’t use the App to break the law, send spam, collect data you have no right to collect, or interfere with the App or other merchants. For Pollsy: don’t ask customers for passwords, payment details, health information or other sensitive data in survey questions. For GiftSplit: only enter recipient details you are entitled to use for delivering a gift.
You own your store data and your customers’ data. You give us permission to process it only to provide the App. See section 6 and the App’s privacy policy.
When we process personal data of your customers for you:
You are responsible for having a lawful basis and any consent needed to collect and use your customers’ data, including when you send it to tools you connect.
Integrations (for example Klaviyo, Meta, Google, Slack) are provided by other companies under their own terms. We aren’t responsible for them.
We own the App and its content. You get a non-exclusive, non-transferable right to use it while it’s installed. Feedback you give us can be used to improve the App.
Scores, grades, profit figures, shipping quotes and recommendations are estimates based on your store data and the settings you enter. Check important decisions yourself. We are not liable for business decisions made using the App.
We aim to keep the App available at all times but don’t guarantee uninterrupted service.
The App is provided “as is”. To the extent the law allows, Lab89 is not liable for indirect or consequential losses, lost profits or lost data. Our total liability is limited to the fees you paid for the App in the 3 months before the claim.
You can stop at any time by uninstalling the App. We may suspend or end your access if you breach these terms or don’t pay, or if we stop offering the App, with reasonable notice where possible.
We may update these terms. If we make important changes we’ll tell you in the App or by email. Using the App after that means you accept them.
These terms are governed by the laws of Malaysia.
